Terms of Use

1. About these terms

These terms govern your use of the Zencut mobile app and related services (“Zencut”), published by LIMNOS, SAS with share capital of €1,500, RCS Paris 939 846 150, 24 rue Keller, 75011 Paris, France (“Limnos”, “we”, “us”). By creating an account or using Zencut, you accept these terms. Our Privacy Policy explains how we handle your personal data.

2. The service

Zencut is an AI video editor for people who talk to camera. You upload a video, and Zencut transcribes it, suggests the parts to keep and lets you export an edited version. Features may change over time as we improve the app.

3. Your account

You must be at least 16 years old to use Zencut. You agree to provide accurate information, keep your sign-in details secure and not share your account. You are responsible for what happens under your account. Tell us at hello@zencut.ai if you think someone else has accessed it.

4. Subscription and payment

• Using Zencut requires a paid subscription. Available plans and prices, including taxes, are shown in the app before you buy.
• Subscriptions are bought and billed through the Apple App Store or Google Play, under their terms. Your payment is handled by Apple or Google, not by us.
• Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends. You can manage or cancel your subscription in your App Store or Google Play account settings. Cancelling stops the next renewal; you keep access until the end of the period already paid.
• If a free trial is offered, it turns into a paid subscription at the end of the trial unless you cancel before.
• Deleting the app or your Zencut account does not cancel your subscription.
• Refunds are handled by Apple or Google under their policies.

5. Right of withdrawal

If you are a consumer in the European Union, you may have a legal right to withdraw from a subscription within 14 days of purchase. Because subscriptions are bought through the App Store or Google Play, withdrawal and refund requests are handled by Apple or Google under their terms and the applicable law.

6. Your content

You keep all rights to the videos you upload and the edits you export (“your content”). To run Zencut, you grant Limnos a worldwide, non-exclusive, royalty-free licence to host, copy, process and transform your content, including through our service providers such as AI providers, only to provide the service to you. This licence ends when you delete the content or your account.

You confirm that you have the rights needed to upload your content, including the consent of the people who appear or are heard in it, and that it does not break the law or anyone else's rights.

7. AI-generated results

Transcripts and edits are produced automatically and may contain mistakes, such as a misheard word or a cut in the wrong place. Review your videos before publishing them. You are responsible for what you publish.

8. Acceptable use

You agree not to:

• upload content that is illegal, hateful, violent, sexually explicit involving minors, or that infringes anyone's rights;
• try to access other users' data, bypass the subscription or security measures, or disrupt the service;
• copy, decompile or reverse-engineer the app, except where the law allows it;
• use Zencut through automated means or to build a competing service.

9. Our intellectual property

The app, the website, the Zencut name, logo and mascot belong to Limnos. We grant you a personal, non-exclusive, non-transferable licence to use the app for your own purposes while your account is active. Nothing in these terms transfers our rights to you.

10. Availability

We work to keep Zencut available and your content safe, but we can't guarantee that the service will be uninterrupted or error-free. We may interrupt it for maintenance. Keep your own copies of your original videos.

11. Suspension and termination

You can stop using Zencut and delete your account at any time from the app. We may suspend or close your account if you seriously or repeatedly break these terms, after warning you when possible. If we stop offering Zencut, we will tell you in advance so you can download your exports.

12. Liability

To the extent permitted by law, Limnos is not liable for indirect losses, such as lost profits or lost audience, or for content you publish. Nothing in these terms limits our liability for gross negligence, wilful misconduct or personal injury, or your rights as a consumer, including the legal guarantee of conformity for digital services.

13. Changes to these terms

We may update these terms. If the changes are significant, we will let you know in the app or by email before they apply. If you don't agree, you can stop using Zencut and cancel your subscription.

14. Apple App Store

If you downloaded Zencut from the Apple App Store:

• These terms are between you and Limnos, not Apple. Limnos, not Apple, is solely responsible for the app and its content.
• Your licence to use the app is limited to Apple-branded devices you own or control, as allowed by the App Store's Usage Rules.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation regarding the app.
• Limnos, not Apple, is responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
• If a third party claims that the app infringes its intellectual property rights, Limnos, not Apple, is responsible for the investigation, defence, settlement and discharge of that claim.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• You must comply with applicable third-party terms when using the app.
• Apple and its subsidiaries are third-party beneficiaries of these terms and, once you accept them, Apple has the right to enforce them against you.

15. Governing law and disputes

These terms are governed by French law. If you are a consumer, you also keep the protection of the mandatory rules of the country where you live. If a dispute arises, contact us first at hello@zencut.ai so we can try to solve it. If you are a consumer, you may also use a consumer mediation service free of charge. Otherwise, the dispute will go to the competent courts.
